On March 5, 2007, the Honorable Gerard E. Lynch granted preliminary approval to the partial settlement reached between Lead Plaintiffs and defendant BAWAG and, among other things, ordered:

Notice of (I) Pendency and Proposed Partial Settlement of Class Action with BAWAG, and (II) Hearing on Proposed Partial Settlement, to be mailed by first-class mail to Class members; and
Summary Notice of Pendency and Proposed Partial Settlement of Class Action with BAWAG P.S.K. and Hearing on Proposed Settlement, to be published on one occasion in the national edition of The Wall Street Journal.
